In particular, it aims at developing legal structures that align repatriation with contemporary international human rights standards. To do so, it gathers the most valuable lessons learned from different repatriation laws and frameworks adopted in the United States and Canada. In both countries, very different ways of approaching repatriation have been used for several decades, highlighting the context-dependent nature of repatriation. The volume is divided into four parts, looking first at international law, then at the national legal landscape in the United States, followed by Canada, before the different repatriation models are evaluated against the backdrop of human rights law standards. Emphasis is placed not only on repatriation-specific legislation but also on the legal context in which it was developed and operates. In turn, the fourth part develops various models on the basis of these experiences that can be aligned with contemporary indigenous and cultural rights. The book ends by considering the models' suitability for international repatriation and the lessons that can be learned from them. The primary audience includes those addressing the legal hurdles to repatriation, be they researchers, policymakers, communities, or museums. 001443973 588__ $$aOnline resource; title from PDF title page (SpringerLink, viewed February 7, 2022). 001443973 650_0 $$aCultural property$$xRepatriation$$zUnited States. 001443973 650_0 $$aCultural property$$xRepatriation$$zCanada. 001443973 650_0 $$aIndigenous peoples$$xReligion. 001443973 650_6 $$aPatrimoine culturel$$xRestitution$$zÉtats-Unis. 001443973 650_6 $$aPatrimoine culturel$$xRestitution$$zCanada. 001443973 650_6 $$aAutochtones$$xReligion. 001443973 655_0 $$aElectronic books. 001443973 77608 $$iPrint version:$$aTünsmeyer, Vanessa.$$tRepatriation of sacred indigenous cultural heritage and the law.$$dCham, Switzerland : Springer, [2022]$$z3030890465$$w(OCoLC)1267586212 001443973 830_0 $$aStudies in art, heritage, law and the market ;$$vv. 3.$$x2524-7433 001443973 852__ $$bebk 001443973 85640 $$3Springer Nature$$uhttps://univsouthin.idm.oclc.org/login?url=https://link.springer.com/10.1007/978-3-030-89047-6$$zOnline Access$$91397441.1 001443973 909CO $$ooai:library.usi.edu:1443973$$pGLOBAL_SET 001443973 980__ $$aBIB 001443973 980__ $$aEBOOK 001443973 982__ $$aEbook 001443973 983__ $$aOnline 001443973 994__ $$a92$$bISE
