This type of exception allows using protected biological matter for breeding new varieties of plants. The breeder's exception is widely accepted under plant variety legislation, but it is not common under patent laws despite the fact that patent rights often cover plant varieties. Only few European countries have adopted such an exception. After the entry into force of the Agreement on a Unified Patent Court, the exception will be mandatory for all European Union Member states. Based on a legal and economic approach, this book offers guidance to those countries that need to incorporate a breeder's exception into their national patent systems and suggests the importance of the exception for promoting plant breeding activities. 000727476 63000 $$aAgreement on Trade-Related Aspects of Intellectual Property Rights$$d(1994 April 15) 000727476 650_0 $$aPlants, Cultivated$$xPatents. 000727476 650_0 $$aPlant varieties$$xPatents. 000727476 650_0 $$aIntellectual property. 000727476 650_0 $$aPlant biotechnology$$xLaw and legislation. 000727476 650_0 $$aRight to food$$xLaw and legislation. 000727476 77608 $$iPrint version:$$z9783319157702 000727476 830_0 $$aInternational law and economics (Springer (Firm)) 000727476 85280 $$bebk$$hSpringerLink 000727476 85640 $$3SpringerLink$$uhttps://univsouthin.idm.oclc.org/login?url=http://link.springer.com/10.1007/978-3-319-15771-9$$zOnline Access$$91397441.1 000727476 909CO $$ooai:library.usi.edu:727476$$pGLOBAL_SET 000727476 980__ $$aEBOOK 000727476 980__ $$aBIB 000727476 982__ $$aEbook 000727476 983__ $$aOnline 000727476 994__ $$a92$$bISE
